- "My fellow Americans. Over a century ago, this nation erected a monument in New York Harbor. A Statue of Liberty. That statue looked down upon Ellis Island, where thousands of immigrants came to seek refuge from a home country that didn't want them, that wouldn't have them. But America took them in. That is our story! The American people today stand as one with history. No longer will our alien visitors be strangers - committed to the shadows, forced to the fringes of a hostile and unwelcoming world. They will be granted the full rights and privileges of American citizens. The Statue of Liberty will stand for aliens, too."
- —The Alien Amnesty Act as read out by Olivia Marsdin.[src]
New York was a state located in the United States (Earth-38). New York City was the largest city in this state.[1] The state bordered Pennsylvania to the south-west, New Jersey to the south (along with the nearby city of Newark), Connecticut to the south-east, Massachusetts to the east, and Vermont to the north-east, with the latter three forming the region of New England. The Canadian border lies to the state's northern edge. These states were destroyed during the Anti-Monitor Crisis, along with the rest of its Earth (Earth-38).
History
At some point, New York became a state of the United States. Sometime after this, the state was labeled on a map used by Indigo.[2]

In her speech about the Alien Amnesty Act, President Olivia Marsdin describes Ellis Island as a place where "thousands" of immigrants came to America. In reality, the number was in the "millions", In a speech designed to praise immigration.[3]
KPJT News reporting on Supergirl's assistance with the National City Fire Department, similar to a preceding incident at the National City Port.
KPJT News uses a background of New York City to advertise its news broadcasts on Channel 3 in National City; California (all the way across the country), whenever the reporters were speaking about emergencies that are ideally suited for Supergirl's assistance; this is visually similar to the channel KGMQ News 3, which also operates in Metropolis (Earth-75) and later for National City (Earth-Prime).[4][5]
Raised in a family with a long military tradition (like her father and grandfather before him), Lucy Lane attended the United States Military Academy at West Point; New York, where she earned a Bachelor of Science degree and a commission in the United States Army as a 2nd lieutenant. Afterwards, Lucy studied at Harvard University in Massachusetts, where she gained a JD/MBA.[6]
- "I ran a diagnostic of your personality and calculated with a 98.7% certainty that you either collected dirt- -or New York Mets baseball cards. And judging from the last 783 uninterrupted Major League seasons, I figured dirt was more likely to hold its value."
- —Brainy to Winn[src]
According to Brainy, running a diagnostic of Winn Schott's personality calculates that he has a 98.7% chance of collecting such objects as either New York Mets baseball cards or a canister of dirt; however, given that there are 783 uninterrupted seasons of Major League Baseball played since (likely by the mid-late 2600s; specifically around 2654-2686), Brainy preferred to give the pile of dirt to Winn, as he perceived that it holds its value better from 31st-century Earth (Earth-38).[7]
According to the Alien Amnesty Act, the United States (Earth-38) erected a monument in New York Harbor; a landmark titled the Statue of Liberty. The monument looked down upon Ellis Island, with a very similar function to the structure on Shelley Island, even including the torch and/or its rough outline shape.[8]
In late 2019, the state was destroyed by a wave of antimatter, along with the rest of Earth-38.[9]
